The Alliance of Country Place Advocates is an informal group of concerned Country Place homeowners created to provide information and share alternative perspectives with other Country Place homeowners regarding agendas set forth by the Country Place HOA Board.

In January 2019, the Country Place HOA Board distributed Proposed Deed Restrictions to the homeowners to be voted on by the end of 2019. They are now campaigning for a quick vote to implement the restrictions. The neighborhood as a whole was never given the opportunity to discuss or consider the restrictions prior to being asked to vote. While many of us agree with the general intent of these restrictions, as a group we are concerned that the restrictions as written are unnecessarily vague and ambiguous, subject to multiple interpretations, and, overall, grant the Board more power than is appropriate to address issues in our neighborhood. We are encouraging other CP homeowners to carefully read the restrictions and do their own research to insure they are making a fully informed decision. Deed restrictions are covenants that run with the land in perpetuity (i.e. forever, unless and until they are affirmatively changed). What this Board promises will not bind a future board. We believe a vote to curtail the property rights of all CP owners should be based on information, not on assurances.
Please take the time to consider both sides of this proposal. Your vote affects everyone in the neighborhood. We ask that you weigh carefully the pros and cons and do your own research before casting your vote. Remember, votes are not due until December 31, 2019. There is plenty of time to research the issues, discuss the concerns with other neighbors, and seek legal advice before voting.

Please take a moment to read the letter we received in response to our inquiry to Bill Davis, an attorney recommended by the HOA Reform Coalition, as to whether our concerns, as presented on this website, regarding the Proposed Deed Restrictions (PDRs) are valid and whether implementation of the PDRs poses a significant litigation risk to our community. At the 2019 Annual Home Owners Meeting, Jason R. Reed, the attorney for Country Place, Inc., commented that he had prosecuted many of these proposed restrictions that had been implemented by other communities and defended many of them as well. That suggests to me that the comments in Bill Davis' letter below regarding the "litigation vortex" are certainly valid. We are already embroiled in a lawsuit set for jury trial in October that has likely cost tens of thousands of dollars, or certainly will by the time it is over. We should all ask ourselves, regardless whether we are for or against the idea of short-term rentals or the other 15 PDRs, if this is really the best time to take preventative measures against a potential STR problem when the law regarding STR restrictions is just developing and our dues are already increasing?
